The Supreme Court of Pakistan prevented the Federal Investigation Agency (FIA) from investigating the alleged irregularities in the BRT Peshawar project, as the Khyber Pakhtunkhwa government requested that the matter be postponed.
A three-member bank of the superior court headed by Judge Umar Ata Bandial heard appeals from the Khyber Pakhtunkhwa Government and the Peshawar Development Authority (PDA).
The appeals challenged the order, approved by the Peshawar High Court (PHC) ordering the FIA to conduct an investigation into the different aspects of the Peshawar BRT project.
The court upheld its provisional order for the third time, stopping the FIA’s investigation into the alleged irregularities in the project.
Previously, on February 3, the court approved a provisional order, restricting the FIA from conducting the investigation, and later on March 17, the court upheld its provisional order.
The court again extended its provisional order after the KP government requested a postponement in the matter that the court accepted and postponed the hearing.
KP’s Advocate General filed with the court that since the lead attorney is not present, the case was therefore adjourned, adding that pursuant to the latest court order, details regarding the project were presented .
Judge Bandial, however, noted that the court did not want to delay the appeal for a long time. The bank noted that it would examine many aspects of the project in detail and examine its transparency, as well as the process under which the contract for construction was awarded.
Judge Bandial noted that the court will also examine whether there is a conflict of interest in the project or not, adding that the SC will also verify whether the provincial government has spent billions of rupees on incomplete projects.
Judge Bandial questioned whether the project was launched without the necessary preparations, adding that frequent changes to the project design were made with public money. The judge said the court will also examine the delay in completing the project.
Meanwhile, the court adjourned the hearing to the date on the charge.

جج بانڈیال نے نوٹ کیا کہ عدالت اس بات کی بھی جانچ کرے گی کہ آیا اس منصوبے میں مفادات کا کوئی تنازعہ ہے یا نہیں ، ایس سی بھی اس بات کی تصدیق کرے گا کہ صوبائی حکومت نے نامکمل منصوبوں پر اربوں روپے خرچ کیے ہیں یا نہیں۔
جج بانڈیال نے سوال کیا کہ کیا پروجیکٹ کو ضروری تیاریوں کے بغیر شروع کیا گیا ، انہوں نے مزید کہا کہ اس منصوبے کے ڈیزائن میں بار بار تبدیلیاں عوام کے پیسوں سے کی گئیں۔ جج نے کہا عدالت اس منصوبے کو مکمل کرنے میں تاخیر کا بھی جائزہ لے گی۔
