آئی ایچ سی نے دہری شہریت والے ایس اے پی ایم کو ختم کرنے کی درخواست کو مسترد کردیا
اسلام آباد ہائیکورٹ نے جمعرات کو وزیر اعظم کے خصوصی معاونین (ایس اے پی ایم) کی دہری شہریت رکھنے والی برطرفی کی درخواست کو مسترد کردیا۔
آئی ایچ سی کے چیف جسٹس (سی جے) جسٹس اطہر من اللہ نے فیصلے کو پڑھ کر سنایا۔
اپنے فیصلے میں عدالت نے کہا ہے کہ وزیر اعظم کے معاون خصوصی کی دوہری شہریت ہونے پر نااہل نہیں ہوسکتا۔
فیصلے میں کہا گیا ہے کہ دوہری شہریت کا حامل شخص بھی پاکستانی ہے اور اس کی حب الوطنی پر شک نہیں کیا جاسکتا۔
فیصلے میں مزید کہا گیا ہے کہ معاون خصوصی کی تقرری وزیر اعظم کا مقدمہ ہے ، اس معاملے میں خصوصی معاونین کی تعداد پر کوئی پابندی نہیں ہے۔
فیصلے میں کہا گیا ہے ، “وزیر اعظم عوام کے جوابدہ ہیں اور وہ تنہا ریاستی نظام نہیں چلا سکتے ہیں۔”
اس سے قبل آج ہی ، آئی ایچ سی نے اپنا فیصلہ محفوظ کرلیا تھا کہ آیا وزیر اعظم کے لئے خصوصی معاونین کی تقرری کو چیلنج کرنے والا کوئی مقدمہ قابل سماعت ہے۔ جمعرات کو چیف جسٹس اطہر من اللہ نے فیصلہ محفوظ کرلیا۔ “آئین میں یہ کہاں لکھا ہے کہ معاون دوہری شہریت نہیں رکھ سکتے ہیں؟” اس نے پوچھا.
انہوں نے استدعا کی کہ عدالت قومی مفاد کی خاطر چاروں ایس اے پی ایم کو ان کے عہدوں سے ہٹانے کے لئے ہدایات جاری کرے کیونکہ انہیں ایٹمی اثاثوں سمیت ملک کے بارے میں حساس معلومات تک رسائی حاصل ہے۔
درخواست گزار نے عدالت سے یہ بھی کہا کہ وہ چار ایس اے پی ایم ایس کو کام کرنے سے باز رکھیں جب تک کہ اس کیس کا فیصلہ نہ ہوجائے۔
The Islamabad High Court on Thursday rejected the petition to remove the Prime Minister’s Special Assistant (SAPM), who was a dual national.
IHC Chief Justice (CJ) Judge Athar Minallah read the verdict.
In its judgment, the court found that the Prime Minister’s special assistant cannot be disqualified for dual citizenship.
The ruling states that a person with dual citizenship is also a Pakistani and that his patriotism cannot be questioned.
The ruling also states that the appointment of a special assistant is the prime minister’s prerogative. In this case, there is no limit to the number of special assistants.
“The Prime Minister is responsible to the people and cannot run the state system alone,” the ruling said.
The IHC had reserved its verdict earlier this morning on whether a case contesting the appointment of special assistants to the Prime Minister could be brought to justice. Supreme Judge Athar Minallah reserved the verdict on Thursday. “Where does the constitution say that assistants cannot have dual citizenship?” he asked.
He argued that, for reasons of national interest, the court should issue instructions on how to remove the four SAPMs from their posts, given that they have access to sensitive information about the country, including its nuclear assets.
The petitioner also asked the court not to process the four SAPMS until they had decided the case.
