سپریم کورٹ نے نیب میں غیر قانونی تقرریوں کا نوٹس لے لیا
بدھ کو سپریم کورٹ کو بتایا گیا کہ ڈائریکٹر جنرل قومی احتساب بیورو (نیب) راولپنڈی عرفان نعیم منگی کے پاس اینٹی گرافٹ باڈی میں اہم مقام کے لئے مطلوبہ اہلیت یا تجربہ نہیں ہے۔
عرفان منگی کی اہلیت اس وقت منظر عام پر آئی جب جسٹس مشیر عالم اور جسٹس قاضی فائز عیسی پر مشتمل عدالت عظمیٰ کے دو رکنی بینچ نے ملزم محمد ندیم کی درخواست ضمانت کی سماعت کی ، جس نے خود کو نیب آفیسر کا بھیس بدل کر استعمال کیا تھا۔ لوگوں کو بہت سے معاملات میں احسان دینے کے لئے دھوکہ دینا۔
عدالت نے اینٹی گرافٹ باڈی میں مبینہ غیر قانونی تقرریوں کا نوٹس لیتے ہوئے اٹارنی جنرل کو نوٹس جاری کردیا۔ جسٹس قاضی فائز عیسیٰ نے ڈپٹی پراسیکیوٹر جنرل نیب سے پوچھا کہ اس طرح کی تقرریوں کے دوران نیب کے چیئرمین آئین اور قانون کو کس طرح نظرانداز کرتے ہیں۔
عدالت نے مشاہدہ کیا کہ قومی احتساب آرڈیننس (این اے او) 1999 کی دفعہ 28 (جی) آئین کے آرٹیکل 240 کے خلاف ہے۔ آئین کے آرٹیکل 240 کا تعلق پاکستان کی خدمات سے متعلق تقرریوں اور خدمات کی شرائط سے ہے۔
جسٹس فائز عیسیٰ نے ریمارکس دیتے ہوئے کہا کہ نیب کے کس قانون کے تحت تقرریاں کی گئیں ، انہوں نے مزید کہا کہ نیب کے چیئرمین جسٹس (ر) جاوید اقبال اب جج نہیں ہیں ، لہذا وہ انہیں عدالت میں طلب کرکے اس سے پوچھ گچھ کرسکتے ہیں۔
عدالت نے نیب کے تمام ڈائریکٹر جنرلوں (ڈی جی) کی تقرری سے متعلق تفصیلات طلب کیں۔ عدالت نے سوال کیا کہ عرفان نعیم منگی کو ملازمت کے لئے بظاہر اہلیت نہ ہونے کے باوجود کیسے مقرر کیا گیا تھا۔
The Supreme Court was informed on Wednesday that the Director General of the National Accountability Bureau (NAB), Rawalpindi Irfan Naeem Mangi, did not have the necessary qualifications or experience for the important position in the anti-graft panel.
Irfan Mangi’s qualifications came to the surface when a two-man bank of the Apex court, consisting of Judge Mushir Alam and Judge Qazi Faez Isa, heard the bail of a defendant Muhammad Nadeem, who had disguised himself as a NAB officer and was using people cheat to find a favor in many matters.
While taking note of the alleged illegal appointments to the Anti-Transplant Panel, the court sent a notice to the Attorney General. Judge Qazi Faez Isa asked the Deputy Prosecutor General NAB how the NAB chairman circumvented the constitution and the law when making such appointments.
The court found that section 28 (g) of the 1999 National Accountability Regulation (NAO) corresponds to Article 240 of the Constitution. Article 240 of the Constitution concerns appointment to the Pakistan service and terms of service.
“According to which NAB law the appointments were made,” said Judge Faez Isa, adding that NAB presiding judge (R) Javed Iqbal is no longer a judge, so you can call him in court and question him.
The court asked for details regarding the appointment of all Directors General of the NAB. The court asked how Irfan Naeem Mangi was appointed even though he apparently did not have the necessary qualifications for the job.
