سپریم کورٹ نے سندھ بھر کی سرکاری زمینوں پر قبضے ختم کرنے کا حکم دے دیا
The Supreme Court in a case related to computerization of government land records has ordered to end occupation of government lands across Sindh.
A three-member bench headed by Chief Justice of Pakistan Gulzar Ahmed heard various cases related to encroachment and occupation in Shar-e-Quaid at the Supreme Court Karachi Registry.
During the hearing, Chief Justice of the Supreme Court Gulzar Ahmed asked a senior officer of the Board of Revenue how much government land had been relinquished.
However, after not getting a satisfactory reply from the senior official, the court reprimanded the officer and remarked that don’t play games with us. They try to fool us by posting pictures of the corners?
He further remarked that don’t tell us the stories of the committee, end the occupation, even the anti-encroachment courts are not doing anything, there is a case in a city like Sukkur.
During the hearing, a senior Revenue official said that we are trying to computerize the records.
Meanwhile, Justice Ijaz-ul-Ahsan remarked that the whole of Hyderabad is encroached, there are no cases in Hyderabad, Larkana, Sukkur and Benazirabad while there are only 9 cases of occupation of the whole of Karachi.
Addressing the Accountant General, the Chief Justice said, “AG, what are these officers doing, they are only protecting their own interests, who are these people serving? If you go somewhere else, immediate action is taken.
Chief Justice Gulzar Ahmed remarked that these officers take possession and take extortion, those who are working in the field are separated, senior member’s medal was awarded but senior member has to work or not?
During the hearing, Justice Qazi Amin remarked that they are employees of the state and not of any caste. Why don’t you send a complaint? What are your interests?
Justice Qazi Amin remarked that you have joined the mafia? Protecting them? Half of Karachi is occupied, see Malir, Gulistan-e-Jauhar, University Road.
Chief Justice Gulzar Ahmed remarked that these 15 and 20 storey buildings are legal. You don’t see that everything is illegal.
He further remarked that all are made with the connivance of revenue, all are made on fake papers, look at Malir river and Korangi bridge.
On which the revenue officer said that action is being taken in Korangi.
Chief Justice Gulzar Ahmed remarked, “Now the rates there will be higher for you. Now you will say that the Supreme Court has ruled that there will be higher rates for demolition.”
Justice Qazi Mohammad Amin remarked, “The conduct of the senior official is deplorable. AG, what will he do when he is not following the court order?
Chief Justice Gulzar Ahmed remarked that the so-called motorway that has been built is under occupation. What is happening on the lands behind and around Bahria Town?
The court rejected the senior member’s report on ending the occupation of government lands.
The apex court directed the revenue officer to fully implement the court order to end the occupation of government lands across Sindh and submit a comprehensive report within a month.

سپریم کورٹ کراچی رجسٹری میں چیف جسٹس پاکستان گلزار احمد کی سربراہی میں تین رکنی بینچ نے شہر قائد میں تجاوزات اور قبضے سے متعلق مختلف کیسز کی سماعت کی۔
سماعت کے دوران سپریم کورٹ کے چیف جسٹس گلزار احمد نے بورڈ آف ریونیو کے سینئر افسر سے پوچھا کہ کتنی سرکاری زمین واگزار کرائی گئی؟
تاہم سینئر اہلکار کی جانب سے تسلی بخش جواب نہ ملنے پر عدالت نے افسر کی سرزنش کی اور ریمارکس دیے کہ ہمارے ساتھ کھیل مت کھیلو۔ وہ کونوں کی تصویریں لگا کر ہمیں بیوقوف بنانے کی کوشش کرتے ہیں؟
انہوں نے مزید ریمارکس دیے کہ ہمیں کمیٹی کی کہانیاں نہ سنائیں، قبضہ ختم کروائیں، انسداد تجاوزات عدالتیں بھی کچھ نہیں کر رہیں، سکھر جیسے شہر میں کیس ہے۔
سماعت کے دوران ریونیو کے ایک سینئر افسر نے کہا کہ ہم ریکارڈ کو کمپیوٹرائز کرنے کی کوشش کر رہے ہیں۔
اس دوران جسٹس اعجاز الاحسن نے ریمارکس دیئے کہ پورا حیدرآباد تجاوزات کا شکار ہے، حیدرآباد، لاڑکانہ، سکھر اور بے نظیر آباد میں کوئی کیس نہیں جب کہ پورے کراچی پر قبضے کے صرف 9 کیس ہیں۔
چیف جسٹس نے اکاؤنٹنٹ جنرل کو مخاطب کرتے ہوئے کہا کہ اے جی یہ افسران کیا کر رہے ہیں، صرف اپنے مفادات کا تحفظ کر رہے ہیں، یہ لوگ کس کی خدمت کر رہے ہیں؟ اگر آپ کہیں اور جائیں تو فوری کارروائی کی جاتی ہے۔
چیف جسٹس گلزار احمد نے ریمارکس دیئے کہ یہ افسران قبضہ کرکے بھتہ لیتے ہیں، فیلڈ میں کام کرنے والوں کو الگ کردیا جاتا ہے، سینئر ممبر کا میڈل دیا گیا لیکن سینئر ممبر نے کام کرنا ہے یا نہیں؟
سماعت کے دوران جسٹس قاضی امین نے ریمارکس دیئے کہ ریاست کے ملازم ہیں کسی ذات کے نہیں۔ آپ شکایت کیوں نہیں بھیجتے؟ آپ کے مشاغل کیا ہیں؟
جسٹس قاضی امین نے ریمارکس دیئے کہ کیا آپ مافیا میں شامل ہو گئے ہیں؟ ان کی حفاظت؟ آدھے کراچی پر قبضہ ہے، ملیر، گلستان جوہر، یونیورسٹی روڈ دیکھیں۔
چیف جسٹس گلزار احمد نے ریمارکس دیئے کہ یہ 15 اور 20 منزلہ عمارتیں قانونی ہیں۔ آپ یہ نہیں دیکھتے کہ سب کچھ غیر قانونی ہے۔
انہوں نے مزید ریمارکس دیئے کہ سب ریونیو کی ملی بھگت سے بنتے ہیں، سب جعلی کاغذات پر بنتے ہیں، ملیر ندی اور کورنگی پل کو دیکھ لیں۔
جس پر ریونیو افسر نے کہا کہ کورنگی میں کارروائی ہو رہی ہے۔
چیف جسٹس گلزار احمد نے ریمارکس دیے کہ اب آپ کے لیے وہاں ریٹ زیادہ ہوں گے، اب آپ کہیں گے کہ سپریم کورٹ نے فیصلہ دیا ہے کہ گرانے کے زیادہ ریٹ ہوں گے۔
جسٹس قاضی محمد امین نے ریمارکس دیے کہ ’اعلیٰ افسر کا رویہ افسوسناک ہے۔ اے جی جب عدالتی حکم پر عمل نہیں کررہے تو کیا کریں گے؟
چیف جسٹس گلزار احمد نے ریمارکس دیئے کہ جو نام نہاد موٹروے بنائی گئی ہے وہ قبضے میں ہے۔ بحریہ ٹاؤن کے پیچھے اور اطراف کی زمینوں پر کیا ہو رہا ہے؟
عدالت نے سرکاری زمینوں پر قبضے ختم کرنے سے متعلق سینئر ممبر کی رپورٹ مسترد کر دی۔
عدالت عظمیٰ نے ریونیو افسر کو سندھ بھر میں سرکاری زمینوں پر قبضے ختم کرانے کے عدالتی حکم پر مکمل عملدرآمد کرنے اور ایک ماہ میں جامع رپورٹ پیش کرنے کی ہدایت کی۔
