سپریم کورٹ نے ایچ ای سی کو غیر قانونی یونیورسٹی کیمپس بند کرنے کا حکم دے دیا
The Supreme Court (SC) on Wednesday directed the Higher Education Commission (HEC) to close all illegal university campuses.
A three-member bench headed by Justice Umar Ata Bandial issued the directions while hearing a case regarding non-issuance of degrees to students from illegal campuses of private universities.
The Supreme Court has also directed the HEC to work out a procedure for awarding degrees to students who have passed through illegal campuses. The court also directed the HEC to ensure implementation of its policies.
The federal and provincial governments have been directed to assist the HEC in maintaining quality education.
The Supreme Court remarked that no compromise would be made on the provision of higher education to the younger generation. He also asked the HEC whether private universities are allowed to set up campuses outside their premises.
On this, the HEC clarified that universities are not allowed to set up campuses outside their premises.
The court, after hearing this, directed the authorities to issue an alert to the private universities in this regard.
The apex court in its order said that the HEC in its position had sought the help of the concerned authorities to curb the illegal activities of the universities but the federal and provincial governments did not assist the commission.
During the hearing, counsel for the petitioner requested the court to direct the National Accountability Bureau (NAB) to take action against the private universities.
On which Justice Umar Ata Bandial remarked that HEC has powers, there is no need to ask NAB for investigation.
سپریم کورٹ (ایس سی) نے بدھ کے روز ہائر ایجوکیشن کمیشن (ایچ ای سی) کو یونیورسٹیوں کے تمام غیر قانونی کیمپس بند کرنے کا حکم دیا۔
جسٹس عمر عطا بندیال کی سربراہی میں تین رکنی بینچ نے نجی یونیورسٹیوں کے غیر قانونی کیمپسز سے طلبہ کو ڈگریاں جاری نہ کرنے سے متعلق کیس کی سماعت کرتے ہوئے یہ ہدایات جاری کیں۔
سپریم کورٹ نے ایچ ای سی کو غیر قانونی کیمپسز سے پاس ہونے والے طلبہ کو ڈگریاں جاری کرنے کا طریقہ کار وضع کرنے کی بھی ہدایت کی ہے۔ عدالت نے ایچ ای سی کو اپنی پالیسیوں پر عملدرآمد یقینی بنانے کی بھی ہدایت کی۔
جبکہ وفاقی اور صوبائی حکومتوں کو معیاری اور معیاری تعلیم کو برقرار رکھنے میں ایچ ای سی کی مدد کرنے کا حکم دیا گیا ہے۔
عدالت عظمیٰ نے ریمارکس دیے کہ نوجوان نسل کو اعلیٰ تعلیم کی فراہمی پر کوئی سمجھوتہ نہیں کیا جائے گا۔ اس نے ایچ ای سی سے یہ بھی پوچھا کہ کیا نجی یونیورسٹیوں کو اپنے احاطے سے باہر کیمپس قائم کرنے کی اجازت ہے۔
اس پر، ایچ ای سی نے واضح کیا کہ یونیورسٹیوں کو اپنے احاطے سے باہر کیمپس قائم کرنے کی اجازت نہیں ہے۔
عدالت نے یہ سننے کے بعد حکام کو ہدایت کی کہ وہ اس سلسلے میں نجی یونیورسٹیوں کو الرٹ جاری کریں۔
عدالت عظمیٰ نے اپنے حکم میں کہا کہ ایچ ای سی نے اپنے موقف میں متعلقہ حکام سے یونیورسٹیوں کی غیر قانونی سرگرمیوں کو روکنے کے لیے مدد مانگی تاہم وفاقی اور صوبائی حکومتوں نے کمیشن کی مدد نہیں کی۔
سماعت کے دوران درخواست گزار کے وکیل نے عدالت سے استدعا کی کہ قومی احتساب بیورو (نیب) کو نجی یونیورسٹیوں کے خلاف کارروائی کا حکم دیا جائے۔
جس پر جسٹس عمر عطا بندیال نے ریمارکس دیئے کہ ایچ ای سی کے پاس اختیارات ہیں، نیب کو تحقیقات کے لیے کہنے کی ضرورت نہیں۔
