سندھ ہائی کورٹ نے وزارت قانون کو نیب انکوائری رولز میں تاخیر کی وضاحت کرنے کا حکم دیا
The Sindh High Court on Tuesday ordered the Federal Ministry to declare the delay to inform the National Accountability Bureau (NAB) about the rules of the investigation and the inquiry.
The NAB prosecutor had a report before a two-member bank led by Justice Muhammad Iqbal Kalhoro on the formulation and approval of rules of inquiry and inquiry into the accountability dog.
The bench was informed that the draft had been sent to President Arif Alvi. The lawyer also said the president had distributed the draft to various ministries and divisions for his opinion.
The NAB prosecutor suggested that the Interior Ministry and the law had expressed some initial reservations about the rules, but a detailed opinion is still awaited.
However, petitioner Tariq Mansoor claimed that the anti-corruption agency had falsified the court as it had given the same excuse in the last hearing.
The petitioner said that at the last hearing, the NAB prosecutor had also informed the court that the rules of the project had been sent to the presidency.
The petitioner argued that the rules should be introduced under Section 34 of the NAB Order. He argued that inquiries and investigations could not be carried out without rules, adding that the NAB had been operating without such rules for the last 20 years.
The court adjourned the case until September 29 and ordered the federal ministry to explain why the rules of the investigation and the inquiry had not yet been communicated.
سندھ ہائی کورٹ نے منگل کو وفاقی وزارت کو حکم دیا کہ وہ قومی احتساب بیورو (نیب) کو تفتیش اور انکوائری کے قواعد سے آگاہ کرنے میں تاخیر کا اعلان کرے۔
نیب پراسیکیوٹر کے پاس جسٹس محمد اقبال کلہوڑو کی سربراہی میں دو رکنی بینک کے روبرو انکوائری کے قوانین کی تشکیل اور منظوری کے بارے میں ایک رپورٹ تھی۔
بنچ کو بتایا گیا کہ مسودہ صدر عارف علوی کو بھیج دیا گیا ہے۔ وکیل نے یہ بھی کہا کہ صدر نے مسودہ مختلف وزارتوں اور ڈویژنوں میں اپنی رائے کے لیے تقسیم کیا ہے۔
نیب پراسیکیوٹر نے تجویز دی کہ وزارت داخلہ اور قانون نے قواعد کے بارے میں کچھ ابتدائی تحفظات کا اظہار کیا تھا ، لیکن تفصیلی رائے کا ابھی انتظار ہے۔
تاہم درخواست گزار طارق منصور نے دعویٰ کیا کہ اینٹی کرپشن ایجنسی نے عدالت کو جھوٹا قرار دیا ہے کیونکہ اس نے گزشتہ سماعت میں بھی یہی عذر پیش کیا تھا۔
درخواست گزار نے کہا کہ گزشتہ سماعت پر نیب پراسیکیوٹر نے عدالت کو بھی آگاہ کیا تھا کہ اس منصوبے کے قواعد ایوان صدر کو بھیجے گئے ہیں۔
درخواست گزار نے دلائل دیتے ہوئے کہا کہ نیب آرڈر کے سیکشن 34 کے تحت رولز متعارف کروائے جائیں۔ انہوں نے دلیل دی کہ انکوائری اور تفتیش قواعد کے بغیر نہیں کی جا سکتی ، انہوں نے مزید کہا کہ نیب گزشتہ 20 سالوں سے ایسے قوانین کے بغیر کام کر رہا ہے۔
عدالت نے کیس کی سماعت 29 ستمبر تک ملتوی کرتے ہوئے وفاقی وزارت کو حکم دیا کہ تفتیش اور انکوائری کے قواعد ابھی تک کیوں نہیں بتائے گئے۔
