سندھ ہائی کورٹ نے حکومت کو کراچی یونیورسٹی کے لیے مختص اراضی سے تجاوزات ہٹانے کی ہدایت کی
The Sindh High Court on Thursday directed the provincial government to remove encroachments on a piece of land allotted for setting up a cancer research institute in Malir District, Karachi.
Former Vice Chancellor of Karachi University Dr. Zafar Saeed Saifi had filed a petition alleging that seven acres of land had been allotted for the establishment of Anti-Cancer Drug Research Institute of Karachi University. However, the land was never handed over and the occupiers surrounded it.
A two-member bench headed by Justice Irfan Saadat Khan had on October 12 issued bailable arrest warrants against the provincial secretary revenue and secretary land utilization department for leaving the hearing despite a court order. The bench then asked the senior member of the Board of Revenue to be present in the court on the next date of hearing.
When the same bench heard the petition on Thursday, Board of Revenue member Shams Soomro appeared with other revenue officials.
Expressing frustration over the absence of a senior member of the Board of Revenue, the bench asked the official why the land was not being handed over to Karachi University. Officials responded that the land had been allotted to someone else and that alternative land would be allotted to the institute.
Petitioner Advocate Asim Iqbal’s counsel argued that the revenue authorities have been making the same statement from the last several hearings.
He said that despite the court orders, neither the original land has been handed over to the institute nor alternative land has been allotted.
The bench set aside the matter for an hour and directed the revenue authorities to prepare senior member Board of Revenue and other senior government officials to appear in court or face contempt proceedings.
When the bench took the petition for re-hearing at 11:00 am, the Secretary Revenue and the Secretary Land Utilization appeared in court.
The bench directed the two secretaries to hand over the vacant and peaceful possession of land and tiles to the institute within 10 days.
The bench clarified that if the order of the court was not complied with within the stipulated time, contempt proceedings would be initiated against both the secretaries.
Following his appearance, the bench also withdrew the arrest warrant.
سندھ ہائیکورٹ نے جمعرات کو صوبائی حکومت کو ہدایت کی کہ وہ کراچی کے ضلع ملیر میں کینسر کے لیے ریسرچ انسٹی ٹیوٹ کے قیام کے لیے مختص اراضی کے ٹکڑے سے تجاوزات ہٹائے۔
کراچی یونیورسٹی کے سابق وائس چانسلر ڈاکٹر ظفر سعید سیفی نے ایک درخواست دائر کی تھی جس میں کہا گیا تھا کہ جامعہ کراچی کے انسداد کینسر ڈرگ ریسرچ انسٹی ٹیوٹ کے قیام کے لیے سات ایکڑ زمین الاٹ کی گئی تھی۔ تاہم ، زمین کا قبضہ کبھی بھی حوالے نہیں کیا گیا اور زمین پر قبضہ کرنے والوں نے اسے گھیر لیا۔
جسٹس عرفان سعادت خان کی سربراہی میں دو رکنی بنچ نے 12 اکتوبر کو عدالتی حکم کے باوجود سماعت چھوڑنے پر صوبائی سیکرٹری ریونیو اور سیکرٹری لینڈ یوٹیلائزیشن ڈیپارٹمنٹ کے قابل ضمانت وارنٹ گرفتاری جاری کیے تھے۔ اس کے بعد بنچ نے سینئر ممبر بورڈ آف ریونیو سے کہا تھا کہ وہ سماعت کی اگلی تاریخ کو عدالت میں موجود رہے۔
جب اسی بینچ نے جمعرات کو درخواست کی سماعت کی تو ممبر بورڈ آف ریونیو شمس سومرو دیگر ریونیو حکام کے ساتھ پیش ہوئے۔
بینچ نے سینئر ممبر بورڈ آف ریونیو کی عدم موجودگی پر مایوسی کا اظہار کرتے ہوئے عہدیدار سے پوچھا کہ زمین کراچی یونیورسٹی کے حوالے کیوں نہیں کی جا رہی؟ حکام نے جواب دیا کہ زمین کسی اور کو الاٹ کی گئی ہے اور متبادل زمین انسٹی ٹیوٹ کو الاٹ کی جائے گی۔
درخواست گزار ایڈووکیٹ عاصم اقبال کے وکیل نے موقف پیش کیا کہ ریونیو حکام گزشتہ کئی سماعتوں سے ایک ہی بیان دے رہے ہیں۔
انہوں نے کہا کہ عدالتی احکامات کے باوجود نہ تو اصل زمین کا قبضہ انسٹی ٹیوٹ کے حوالے کیا گیا ہے اور نہ ہی متبادل زمین الاٹ کی گئی ہے۔
بنچ نے معاملہ ایک گھنٹے کے لیے ایک طرف رکھا اور ریونیو حکام کو ہدایت کی کہ وہ سینئر ممبر بورڈ آف ریونیو اور دیگر سینئر سرکاری افسران کو عدالت میں پیش ہونے یا توہین عدالت کی کارروائی کا سامنا کرنے کے لیے تیار رہیں۔
جب بنچ صبح 11:00 بجے درخواست دوبارہ سماعت کے لیے لے گیا تو سیکریٹری ریونیو اور سیکریٹری لینڈ یوٹیلائزیشن عدالت میں پیش ہوئے۔
بنچ نے دونوں سیکرٹریوں کو ہدایت کی کہ زمین کا خالی اور پرامن قبضہ اور ٹائل 10 دن کے اندر انسٹی ٹیوٹ کے حوالے کریں۔
بنچ نے واضح کیا کہ اگر مقررہ وقت کے اندر عدالت کے حکم پر عمل درآمد نہ ہوا تو دونوں سیکرٹریوں کے خلاف توہین عدالت کی کارروائی شروع کی جائے گی۔
ان کی پیشی کے بعد بنچ نے وارنٹ گرفتاری بھی واپس لے لیے۔
