فیصلہ کسی کی جیت یا ہار نہیں ، شہزاد اکبر
وزیر اعظم کے معاون خصوصی شہزاد اکبر نے کہا جج کے اہل خانہ کو ایف بی آر کو منی ٹریل ادا کرنا ہوگا ۔ سپریم کورٹ کا فیصلہ کسی کی فتح یا شکست نہیں ہے۔ حکومت اس فیصلے سے خوش ہے۔ یہ ایک بہت اچھا فیصلہ ہے۔ ۔
اسلام آباد میں پریس کانفرنس کے دوران ، شہزاد اکبر نے جسٹس قاضی فائز عیسیٰ کو سپریم کورٹ کے فیصلے کے حوالے سے ایک ریفرنس دیا کہ آج سپریم کورٹ کا ایک بہت اہم فیصلہ کیا گیا ہے۔ عدلیہ کی عزت اور آزادی پہلے ہے ، آئین کی بالادستی کا تقاضا ہے کہ انصاف ، قانون سازی اور انتظامیہ آزاد ہو۔
شہزاد اکبر نے کہا کہ آئین میں تین معاملات ہیں جہاں جج کے بارے میں سوال پوچھا جاسکتا ہے ، ایک طرح سے ہر شخص سپریم جوڈیشل کونسل کو معلومات بھیج سکتا ہے ، دوسرے طریقے سے صدر حکومت سے ریفرنس بھیج سکتے ہیں ، جبکہ تیسرا آپشن سپریم کورٹ ہے جو خود اس کا نوٹس لے سکتی ہے۔
انہوں نے کہا کہ صدارتی ریفرنس کو سپریم کورٹ کے سارے بینچ نے منسوخ کردیا ، اس ریفرنس کے تحت جاری کردہ شوکاز نوٹس بھی منسوخ کردیا گیا۔ دونوں چیزوں کو فیصلے کے باقی اثرات پر منحصر کیا گیا ۔
شہزاد اکبر نے کہا کہ جسٹس قاضی فائز عیسیٰ کی اہلیہ اور بچوں کو پیغامات ارسال کیے جائیں گے۔ انکم ٹیکس کے چئیر مین 75 دن میں پورٹ پیش کریں گے ۔ ایف بی آر کے چئیر مین پابند ہیں کہ وہ رپوٹ سائن کر کے کونسل کو بھیجیں ۔
معاونِ خصوصی نے کہا کہ یہ رپورٹ براہ راست سپریم جوڈیشل کونسل کے سکریٹری کو بھیجی جائے گی حکومت کو نہیں۔ سپریم جوڈیشل کونسل اس رپورٹ پر نظرِ ثانی کرے گی ، جبکہ جج کی اہلیہ اور بچوں کو لندن کے تین اپارٹمنٹس اور ایک منی ٹریل کی تفصیلات فراہم کرنے کی ضرورت ہوگی ۔
انہوں نے کہا ، “ہمارا شروع سے ہی یقین تھا کہ ججوں کے معاملے کی جانچ سپریم جوڈیشل کونسل کے ذریعہ ہو۔ حکومت سپریم کورٹ کے فیصلے سے مطمئن ہے۔”
شہزاد اکبر نے کہا کہ ایسا نہیں ہے کہ اس سوال کا کوئی جواب نہ ہو ، لیکن اس کا جواب نہ دینے کا مقصد تنازعہ میں ملوث نہ ہونا ہے۔ ہمیں جس آزادی کے تحت آزادی حاصل ہے وہ ججوں کے ذریعہ محفوظ ہے۔
احتساب کے معاون نے کہا کہ فیصلہ ہونے کے بعد ، ایسا ماحول پیدا کیا گیا جس میں یہ کسی کی فتح یا کسی کی شکست تھی ، جب کہ یہ فتح یا کسی کے لئے شکست نہیں تھی ، اسے کسی اور رنگ میں رنگنا غلط ہے۔

During a press conference in Islamabad, Shehzad Akbar gave a reference to Justice Qazi Faiz Issa regarding the decision of the Supreme Court that a very important decision of the Supreme Court has been taken today. The dignity and independence of the judiciary comes first, the supremacy of the constitution requires that justice, legislation and administration be independent.
Shehzad Akbar said that there are three issues in the constitution where a question can be asked about a judge, one way everyone can send information to the Supreme Judicial Council, the other way they can send a reference to the President, Is the one who can take notice of it.
He said that the presidential reference was canceled by the entire bench of the Supreme Court and the show cause notice issued under this reference was also canceled. Both depended on the rest of the decision.
Shehzad Akbar said that messages would be sent to the wife and children of Justice Qazi Faiz Issa. The Chairman of Income Tax will present the port in 75 days. The FBR chairman is obliged to sign the report and send it to the council.
The Special Assistant said that the report would be sent directly to the Secretary of the Supreme Judicial Council and not to the Government. The Supreme Judicial Council will review the report, while the judge’s wife and children will be required to provide details of three London apartments and a mini-trail.
“From the beginning, we believed that the judges’ case should be investigated by the Supreme Judicial Council. The government is satisfied with the Supreme Court’s decision,” he said.
Shehzad Akbar said that it is not that there is no answer to this question, but the purpose of not answering it is not to get involved in the dispute. The freedom we enjoy is protected by judges.
The Accountability Assistant said that after the decision was made, an atmosphere was created in which it was a victory or a defeat for someone, while it was not a victory or a defeat for anyone, it is wrong to paint it in another color.
