سزا یافتہ افسران کو احتساب عدالتوں سے نکال دیا جائے: سندھ ہائی کورٹ
The Sindh High Court on Friday directed the provincial government not to post officers who have been convicted by accountability courts or are out on bail in references filed by the National Accountability Bureau (NAB).
The order was passed by a division bench headed by Justice Salahuddin Panwar on some similar petitions. The bench directed the Chief Secretary Sindh to ensure implementation of the order or else contempt of court proceedings would be initiated.
The bench also ordered the removal of all provincial government officials who have been convicted by the accountability courts or are out on bail in NAB references.
When the bench convened in the morning, the focal person appointed by the Sindh government presented a report on the posting of two officers.
The loose attitude of the focal person infuriated the bench, and Justice Panhwar failed to order criminal proceedings against him and demanded the whole truth.
The provincial law officer intervened and presented a report on the departments that were directly under the provincial government. He added that reports on 17 other departments were yet to be filed.
The bench set aside the file and directed the focal person to submit the full report after the court break at 11:00 am. It also clarified that it is not currently seeking reports on officers who obtained plebiscite and voluntary return.
After the court adjournment, the focal person informed the bench that 14 officers convicted by the accountability courts are holding posts in the Revenue Department. He added that he has now been removed as per court orders.
The focal person further told the court that the three officers have each been removed from the local government and the forest department. Seven such officers have been removed from the irrigation department.
The focal person said that Cane Commissioner, Section Officer and Director of Workers Welfare Board have also been removed from their posts.
The same bench had on September 28 directed the provincial authorities and the NAB to submit a report on all government officials who had bargained with the authorities, opted for voluntary return and faced trial.
During the hearing of two identical petitions, the bench said that the SHC had earlier issued several orders on the subject and questioned the compliance report filed by the SGA and CD secretary in December last year. Picked up because it did not cover senior officers.
In December, the Sindh High Court directed the Sindh chief secretary to immediately suspend all officials who had reached an application deal or opted for voluntary return. It also ordered the Sindh government to initiate disciplinary action against them.
Initially, two petitions were filed last year against the posting of some officers who returned the embezzled money to the NAB through plebiscite and voluntary return.
Later, Muttahida Qaumi Movement Pakistan (MQM) lawmaker Kanwar Naveed Jamil had also filed a petition in the Sindh High Court alleging that about 500 officials had been re-appointed and promoted who had bargained and volunteered chosen to returnwith the NAB.
سندھ ہائی کورٹ نے جمعہ کو صوبائی حکومت کو حکم دیا کہ وہ ایسے افسران کو پوسٹنگ نہ دیں جو احتساب عدالتوں سے سزا یافتہ ہیں یا قومی احتساب بیورو (نیب) کے دائر ریفرنسز میں ضمانت پر ہیں۔
یہ حکم جسٹس صلاح الدین پنوار کی سربراہی میں ایک ڈویژن بنچ نے کچھ یکساں درخواستوں پر دیا۔ بینچ نے چیف سیکریٹری سندھ کو ہدایت کی کہ وہ حکم پر عمل درآمد کو یقینی بنائیں بصورت دیگر توہین عدالت کی کارروائی شروع کی جائے گی۔
بینچ نے صوبائی حکومت کے ان تمام افسران کو بھی ہٹانے کا حکم دیا جو احتساب عدالتوں سے سزا یافتہ ہیں یا نیب ریفرنسز میں ضمانت پر ہیں۔
جب صبح بنچ جمع ہوا تو سندھ حکومت کی طرف سے مقرر فوکل پرسن نے دو افسران کی پوسٹنگ کے بارے میں رپورٹ پیش کی۔
فوکل پرسن کے ڈھیلے رویے نے بینچ کو مشتعل کردیا ، اور جسٹس پنہوار ان کے خلاف مجرمانہ کارروائی کا حکم دینے میں ناکام رہے اور پوری سچائی کا مطالبہ کیا۔
اس موقع پر صوبائی لاء آفیسر نے مداخلت کی اور ان محکموں کے حوالے سے رپورٹ پیش کی جو براہ راست صوبائی حکومت کے ماتحت تھے۔ انہوں نے مزید کہا کہ 17 دیگر محکموں کے بارے میں رپورٹ ابھی دائر کی جانی ہے۔
بینچ نے فائل کو ایک طرف رکھ دیا اور فوکل پرسن کو ہدایت دی کہ وہ صبح 11:00 بجے عدالتی وقفے کے بعد مکمل رپورٹ پیش کرے۔ اس نے یہ بھی واضح کیا کہ فی الحال یہ ان افسران کے بارے میں رپورٹس نہیں مانگ رہا جنہوں نے پلی بارگین اور رضاکارانہ واپسی حاصل کی۔
عدالتی وقفے کے بعد فوکل پرسن نے بینچ کو آگاہ کیا کہ احتساب عدالتوں سے سزا یافتہ 14 افسران محکمہ ریونیو میں عہدوں پر فائز ہیں۔ انہوں نے مزید کہا کہ اب انہیں عدالتی احکامات کے مطابق ہٹا دیا گیا ہے۔
فوکل پرسن نے عدالت کو مزید بتایا کہ تین افسران کو ہر ایک کو مقامی حکومت اور محکمہ جنگلات سے ہٹا دیا گیا ہے۔ جبکہ اس طرح کے سات افسران کو محکمہ آبپاشی سے ہٹا دیا گیا ہے۔
فوکل پرسن نے کہا کہ کین کمشنر ، سیکشن آفیسر اور ورکرز ویلفیئر بورڈ کے ڈائریکٹر کو بھی ان کے عہدوں سے ہٹا دیا گیا ہے۔
اسی بنچ نے 28 ستمبر کو صوبائی حکام اور نیب کو ہدایت کی تھی کہ وہ تمام سرکاری افسران کے بارے میں رپورٹ پیش کرے جنہوں نے حکام کے ساتھ درخواست سودے بازی کی ، رضاکارانہ واپسی کا انتخاب کیا اور مقدمے کا سامنا کرنا پڑا۔
دو ایک جیسی درخواستوں کی سماعت کے دوران ، بنچ نے کہا کہ اس سے قبل ایس ایچ سی نے اس موضوع پر کئی احکامات جاری کیے تھے اور گزشتہ سال دسمبر میں ایس جی اے اور سی ڈی سیکرٹری کی جانب سے دائر کی گئی تعمیل رپورٹ پر سوال اٹھایا تھا کیونکہ اس نے سینئر افسران کا احاطہ نہیں کیا تھا۔
دسمبر میں ، سندھ ہائی کورٹ نے سندھ کے چیف سیکریٹری کو ہدایت کی تھی کہ وہ تمام عہدیداروں کو فوری طور پر معطل کردیں جو درخواست کے سودے پر پہنچے ہیں یا رضاکارانہ واپسی کا انتخاب کیا ہے۔ اس نے سندھ حکومت کو ان کے خلاف انضباطی کارروائی شروع کرنے کا بھی حکم دیا۔
ابتدائی طور پر ، گذشتہ سال دو درخواستیں کچھ افسران کی پوسٹنگ کے خلاف دائر کی گئیں جنہوں نے پلی بارگین اور رضاکارانہ واپسی کے ذریعے نیب کو غبن شدہ رقم واپس کی۔
بعد ازاں متحدہ قومی موومنٹ پاکستان کے قانون ساز کنور نوید جمیل نے بھی سندھ ہائی کورٹ میں درخواست دی تھی جس میں کہا گیا تھا کہ 500 کے لگ بھگ عہدیداروں کی دوبارہ تقرری اور پروموشن کی گئی ہے جنہوں نے پلی بارگین کی اور نیب کے ساتھ رضاکارانہ واپسی کا انتخاب کیا۔
