عدلیہ کی بے توقیری کرنے والا میں دنیا کا آخری شخص ہوں گا: سابق جسٹس شوکت صدیقی
Former Islamabad High Court Justice Shaukat Aziz Siddiqui, while expressing confidence in the bench of the Supreme Court hearing the petition against dismissal, said that he would be the last person in the world to disrespect the judiciary.
A large bench of the Supreme Court headed by Justice Omar Atabandial heard the appeal against the removal of former Justice Shaukat Aziz Siddiqui of the Islamabad High Court.
Justice Umar Ata Bandial asked the lawyer to give factual arguments instead of making serious allegations. The Supreme Judicial Council twice gave Shaukat Siddiqui a chance to prove the allegations and the court also gave him a chance to prove the allegations made in his speech.
He said that they should also assist the court in the matter of what is misconduct.
During the hearing, former judge Shaukat Aziz Siddiqui said that he could not even think that any member of the bench was biased and even if the petition was rejected, he would not blame the judiciary.
Former Justice Shaukat Aziz Siddiqui said that he would be the last person in the world to disrespect the judiciary.
Justice Sajjad Ali Shah, a member of the bench, while talking to Hamid Khan, counsel for Shaukat Aziz Siddiqui, said that he said that the entire Supreme Judicial Council was biased.
Justice Sajjad Ali Shah said that I was also a member of the Supreme Judicial Council which heard the earlier reference. If the whole council is accused of malice then it is not appropriate for me to sit in the bench. ۔
He said that he was involved in the council but had not yet decided on these references, on which lawyer Hamid Khan said that if one part of the council is biased then the blame falls on the whole body, the written objection is against two judges.
Referring to the Supreme Judicial Council, Justice Sajjad Ali Shah said that the High Court judges in the council do not even know about the case, only notice comes that there is a meeting of the council.
He said that the role of the three members of the council is at the very beginning when writing the decision.
Justice Umar Ata Bandial said that in the proceedings of the Code, if the material is in front then evidence is not required.
The Lajjar Bench of the Supreme Court adjourned the hearing till January.
اسلام آباد ہائی کورٹ کے سابق جسٹس شوکت عزیز صدیقی نے برطرفی کے خلاف درخواست کی سماعت کرنے والے سپریم کورٹ کے بینچ پر عدم اعتماد کا اظہار کرتے ہوئے کہا کہ وہ عدلیہ کی بے عزتی کرنے والے دنیا کے آخری شخص ہوں گے۔
جسٹس عمر عطابندیال کی سربراہی میں سپریم کورٹ کے لارجر بینچ نے اسلام آباد ہائی کورٹ کے سابق جسٹس شوکت عزیز صدیقی کی برطرفی کے خلاف اپیل کی سماعت کی۔
جسٹس عمر عطا بندیال نے وکیل سے کہا کہ سنگین الزامات لگانے کی بجائے حقائق پر مبنی دلائل دیں۔ سپریم جوڈیشل کونسل نے دو بار شوکت صدیقی کو الزامات ثابت کرنے کا موقع دیا اور عدالت نے بھی انہیں اپنی تقریر میں لگائے گئے الزامات ثابت کرنے کا موقع دیا۔
انہوں نے کہا کہ بدتمیزی کے معاملے میں عدالت کی مدد بھی کریں۔
سماعت کے دوران سابق جج شوکت عزیز صدیقی نے کہا کہ وہ سوچ بھی نہیں سکتے کہ بنچ کا کوئی رکن جانبدار ہے اور اگر درخواست مسترد بھی ہو جائے تو عدلیہ پر الزام نہیں لگائیں گے۔
سابق جسٹس شوکت عزیز صدیقی نے کہا کہ وہ عدلیہ کی بے عزتی کرنے والے دنیا کے آخری شخص ہوں گے۔
بینچ کے رکن جسٹس سجاد علی شاہ نے شوکت عزیز صدیقی کے وکیل حامد خان سے مکالمہ کرتے ہوئے کہا کہ ان کا کہنا تھا کہ پوری سپریم جوڈیشل کونسل متعصب ہے۔
جسٹس سجاد علی شاہ نے کہا کہ میں سپریم جوڈیشل کونسل کا ممبر بھی رہا جس نے پہلے ریفرنس کی سماعت کی۔ اگر پوری کونسل پر بدنیتی کا الزام ہے تو میرے لیے بینچ میں بیٹھنا مناسب نہیں۔ ۔
انہوں نے کہا کہ وہ کونسل میں شامل ہیں لیکن ابھی تک ان ریفرنسز پر فیصلہ نہیں ہوا، جس پر وکیل حامد خان نے کہا کہ کونسل کا ایک حصہ جانبدار ہو تو الزام پورے جسم پر پڑتا ہے، تحریری اعتراض دو ججز کے خلاف ہے۔
جسٹس سجاد علی شاہ نے سپریم جوڈیشل کونسل کا حوالہ دیتے ہوئے کہا کہ کونسل میں ہائی کورٹ کے ججز کو کیس کا علم تک نہیں، صرف نوٹس آتا ہے کہ کونسل کا اجلاس ہے۔
انہوں نے کہا کہ فیصلہ لکھتے وقت کونسل کے تین ارکان کا کردار بالکل شروع میں ہوتا ہے۔
جسٹس عمر عطا بندیال نے کہا کہ ضابطہ کی کارروائی میں مواد سامنے ہے تو ثبوت کی ضرورت نہیں۔
سپریم کورٹ کے لجر بینچ نے کیس کی سماعت جنوری تک ملتوی کر دی۔
