آرڈیننس کے نفاذ کے بعد جاوید اقبال نیب کے سربراہ رہیں گے
Following the issuance of the amended National Accountability Ordinance (NAO) 2021 by President Dr. Arif Alvi, former Justice Javed Iqbal will continue to serve as Chairman NAB.
The ordinance states that the current chairman of the NAB will remain in office until a successor is appointed. The President for the post of Chairman NAB will be appointed after consultation between the Prime Minister and the Leader of the Opposition.
“However, if there is no consensus, the president will refer the matter to a parliamentary committee,” the ordinance reads. The committee will consist of 12 members and will be constituted by the Speaker of the National Assembly.
Under the ordinance, the procedure for re-appointment will be the same, but the chairman of the NAB can be removed just like the judges of the Supreme Court.
The president has the power to appoint accountability judges.
The ordinance empowers the president to set up as many accountability courts as he wants in the country. He has also been given the power to appoint judges of the accountability court in consultation with the concerned Chief Justices. Under the new law, the term of judges will be three years.
The amendment also prevents the NAB from interfering in federal, provincial and local tax matters. Similarly, the decisions of the federal and provincial cabinets, committees and sub-committees will not fall under the purview of the NAB.
صدر ڈاکٹر عارف علوی نے ترمیم شدہ قومی احتساب آرڈیننس (این اے او) 2021 کے اجراء کے بعد سابق جسٹس جاوید اقبال چیئرمین نیب کے طور پر کام جاری رکھیں گے۔
آرڈیننس میں کہا گیا ہے کہ موجودہ چیئرمین نیب اس وقت تک اپنے عہدے پر رہیں گے جب تک کوئی جانشین مقرر نہیں ہوتا۔ چیئرمین نیب کے لیے صدر کی تقرری وزیراعظم اور قائد حزب اختلاف کے درمیان مشاورت کے بعد کی جائے گی۔
“تاہم ، اگر اتفاق رائے نہ ہوا تو صدر معاملہ پارلیمانی کمیٹی کو بھیجیں گے ،” آرڈیننس پڑھتا ہے۔ کمیٹی 12 ارکان پر مشتمل ہوگی اور قومی اسمبلی کے اسپیکر کی طرف سے تشکیل دی جائے گی۔
آرڈیننس کے تحت دوبارہ تقرری کا طریقہ کار ایک جیسا ہوگا ، لیکن چیئرمین نیب کو سپریم کورٹ کے ججوں کی طرح ہی ہٹایا جا سکتا ہے۔
صدر کو احتساب جج مقرر کرنے کا اختیار حاصل ہے۔
آرڈیننس صدر کو اختیار دیتا ہے کہ وہ ملک میں جتنی چاہیں احتساب عدالتیں قائم کریں۔ انہیں متعلقہ چیف جسٹسوں کی مشاورت سے احتساب عدالت کے جج مقرر کرنے کا بھی اختیار دیا گیا ہے۔ نئے قانون کے تحت ججوں کی مدت تین سال ہوگی۔
یہ ترمیم نیب کو وفاقی ، صوبائی اور مقامی ٹیکس کے معاملات میں مداخلت سے بھی روکتی ہے۔ اسی طرح وفاقی اور صوبائی کابینہ ، کمیٹیوں اور ذیلی کمیٹیوں کے فیصلے نیب کے دائرہ اختیار میں نہیں آئیں گے۔
